Senate Rejects Act Suspending Certified Tax Statement Obligation

Romania's Senate on Wednesday rejected a government emergency ordinance which, among other provisions, suspended the requirement for companies to certify their tax statements, until January 2013.

The obligation had been introduced through Government Ordinance 47/2007, which amended article 83 of the fiscal procedure code.

The rejected ordinance also amended Emergency Ordinance 25/2001, which exempted local and central authorities from paying the 5% tax on investments to the National Investment Company, for technical assistance.

The Government's act also amended an ordinance on the 2009 budgetary revision, concerning the personnel of the High Council of Magistrates and Supreme Court.

The senators' main issue with the ordinance was that its four articles affect different fields, amending just as many previous acts.

As for tax statement certification, social democrat senator Gheorghe Marcu said the obligation should be annulled, not suspended, since even the Government has pointed out "the extra cost borne by the taxpayers and their dissatisfaction."

The ordinance will now be debated by the Chamber of Deputies.
